Renters’ Rights Bill: The Impact

Today we have written to all our valued landlord clients with an update on important legislation changes that will affect the residential property lettings that we manage for them.
The Renters’ Rights Bill is now a familiar topic of conversation for letting agents across England. Reform of the Private Rented Sector has been on the political to-do list since 2019, and now, with Labour’s majority in government, we will see it become a reality.
Changes set out in the bill will affect all landlords, agents and tenants, so it’s important to look at what impact these changes will have.
The government has published a report which accepts that the changes and additional burdens on landlords and their agents will likely lead to increases in rent, with the legislated costs passed on to tenants in the form of rent.
The government also plans to introduce more direct regulation on landlords, and to empower Trading Standards to enforce these rules.
What we know so far is that the much publicised “No Fault Notice” i.e. Section 21 notices are definitely to be banned, there will be no more assured shorthold tenancies (ASTs) or fixed term contracts. Tenancies will be periodic from day one.
Rent Reviews will be served with a two month notice period by way of a Section 13 notice. Tenants will be entitled to request permission to have a pet, which cannot be reasonably refused.
Should you require possession of your property, there are new “grounds for possession”, both mandatory and discretionary.
This is the biggest overhaul of residential lettings legislation in over 30 years and will bring big changes to the way you as landlord, and we as your managing agent, rent out your properties.
This monumental change to legislation is currently at the House of Lords, Royal Assent is expected as early as summer this year.
