Option agreements on land

Overage agreements for land with development potential
Land has often massively greater market value once a planning consent enabling development is in place. We have many years of expertise in negotiating overage agreements for our clients at the point of a sale.
That means once the development has increased the value of land significantly, an additional payment is due to the landowner granting the overage. Development value realized often long after the land is sold for housing, a renewables project or any non-agricultural use.
A promotion agreement is negotiated between the promoter or development company and a farmer or landowner to promote the latter’s land in the process of gaining planning permission. If planning permission is granted the two work together to market and sell the land to a suitable developer. Once a developer has bought the land the proceeds are split between both parties in the terms negotiated and agreed beforehand. Local Plan reviews
Every 5 years the Local Planning Authorities (LPA’s) review their adopted local plan for allocations and settlement proposals.
